Is being the only adult in the house while drinking while having a 16 yr old daughter living in the household illegal?

I’m kinda dumb, and I tried doing some research but I’m either tired or I didn’t find anything. But I know that this individual can get a DUI, I don’t mean getting CPS involved either, I mean like getting arrested. I’m new to this stuff, please be nice 🙁 also I’m not the adult nor the the child, but any tips for the child would be helpful. Also she does have an option to live with relatives 3 hours away but she wants to live there for cheer leading
